This case was brought by individuals, not the state legislature.
It was started several months ago. The judge dismissed the case against the county, but allowed the plaintiffs to continue by adding individual election workers to be sued in their individual capacity.
This case was to inspect absentee ballots in one county by individuals who made claims of fraud.
It was not a case brought by the state legislature to do a real audit.

It could be legitimately argued that you can't have any individual who wants to inspect the ballots do so, because the libtards would be destroying things left and right after every election loss. These people are witnesses, but not necessarily people who have a right to inspect the ballots themselves.
This has to be an AUDIT, not just an inspection or "re-count." Furthermore, the LEGISLATURE has the authority to do the audit.
The judge might be right here. If the plaintiffs could not articulate THAT THEY WERE INJURED (a necessary element of a lawsuit), then the case should be dismissed. I have not read their complaint, so I don't know if they fucked it up by failing to allege an injury.
If they DID allege an injury, then the judge was wrong to dismiss. If they DID NOT, then he was right.
We have to keep in mind that there are people who will file lawsuits and do it wrong, either by accident or on purpose.
