You are absolutely right. The LIE is intentional and that word carries the proper connotation.
There is nothing illegal about yelling, "Fire!" in a crowded theater. If there really IS a fire, you have a DUTY to inform others. It is only if you are being dishonest that it could be considered illegal, but then fraud is always illegal.
So, is he telling the truth? If yes, then it cannot be censored by the government.
