They are citing the executive order covering federal contractors as well as the OSHA changes to companies with 100+ people.

Permanent hold on mandates. http://www.wbiw.com/2021/11/15/federal-appeals-court-orders-federal-government-to-halt-implementation-of-osha-vaccine-mandate/

According to Patrick Byrne this ruling kills the mandate; it has been issued, challenged, and re-confirmed in event stronger language. No basis for the supreme court to take this one up, so no path for appeals.
