In this case, i'd say the driver since they fell asleep at the wheel and bypassed Tesla's "check" for the driver's hand on the wheel while in autopilot. If I remember right, that's a fail safe built into the car so this type of stuff doesn't happen.
Weird thing is the guy fell asleep in the car (dehydration). Wakes up smack between two cars and the airbags didn't deploy. I was walking by when it happened ten feet off. Had it not been for the parked cars the person in front of me would've been dead.
