It's an important principle of literature that the rules of language (linguistics) are used, twisted, manipulated and often violated. There's a difference between a Van Gogh, for example, and the beautiful paint job Fred did on your house.
A key and critical factor here is intent, purpose. Is the purpose dramatic in nature? Then it's closer to literature than otherwise.
Not sure how to use it, but I think you could use the "CONTEXT" thingumy for this.
