The magic number would be one. And btw, once an elected official violates their oath of office by doing or voting for something unconstitutional, they have effectively 'vacated' their position and should be removed. But how many Americans even know that? Nothing will change until the American citizens learn about their Constitution and start using lawful means to hold politicians accountable.
That's an intriguing idea. We clearly need more teeth in the Constitutional restrictions on government power over the people.
Minor point, you're describing Treason, not insurrection:

treason | ˈtrēzən | noun (also high treason) the crime of betraying one's country, especially [thus, not only] by attempting to kill the sovereign or overthrow the government: they were convicted of treason.
Outstanding idea but I am sorry, One should be enough. They ALL KNOW when they vote for or approve a law that is unconstitutional, and if they do not they need to be made an example. OR, we will soon Not BE The United States of America.
Two tiers, knowingly doing so is treason, doing so though unintentionally, is still serious but lessor. Instituting this would give the people leverage while being fair
Make it retroactive. If they can do it with taxes they can do with treason.
I say you take an oath of office, you are compelled to rigorously uphold and support the Constitution. If you are charged and found guilty of breaking that oath either through enforcement of un-Constitutional laws, introducing un-Constitutional laws, etc., you are convicted of treason and summarily executed....
