They think they can, but no business can violate the law, nor deny you your rights as protected by the Constitution. If they are open to the public, then you, as a member of the public have an irrevocable license to patronize the establishment.
I think they basically take on all legal liability at this point. Can they still require masks and the jab? Probably yes. Can they be sued for any adverse consequences? Yeah, I think so. Before they could always fall back on the “CDC required it” excuse but not now; IMO.
What about other businesses? Do private businesses still have the right to force medical treatments on people?
