I agree with the first part. God's law even calls for 2-3 independent lines of evidence to convict someone. It also calls for anyone making a false accusation to receive the same punishment as the person they were accusing would get if guilty. Talk about perfect justice!
No incarceration is not a form of banishment. Banishment means the expulsion from a city, state, country, or territory. An example would be how the British shipped their criminals to Australia. Incarceration costs a fortune every year. The combined socio-economic costs are even higher. That money comes out of our pockets by threat of force. God calls that theft.
State run prisons are just as bad. They use prisoners (like drug offenders) for labor even striking deals with companies like Foster Farms (Pottery and eggs in AZ) to force convicts to work in horrid conditions for pennies and hour while making a fortune. There is no real rehabilitation in there outside of some basic programs. They are far more interested in you working and not causing trouble. I've seen 18-25 year old kids that got caught with pot or some other light drugs turn into career criminals from the connections and influences they had in there. It just starts a cycle for many.
