It’s not enforceable. I told the HR manager right to her face when they asked me if I could provide proof of Covid vaccination, after lying and saying I had it on the application, that they were opening their company up for a lawsuit if they required me to be vaccinated or to provide medical documentation concerning any private medical matter of mine besides my physical ability to perform the job’s duties and that it would also be a violation of the Americans with Disabilities Act. They hired me and never brought it up. It’s all a bluff.
My best friend was told by an engineering company he was going to be fired and he told them that they cannot legally require him to do it, or provide any of his medical records or private medical information and that firing him would be an act of retaliation.
They can try but anyone who knows how play the game can get a job or have grounds for lawsuit. And we all should. Fuck them.
Excellent idea. Thanks. My company is on pause complying with the Federal contractor mandate, but before the pause they were pushing hard claiming we’d have to get vaxxed or be let go. It’s an insane game of chicken. I like the ADA approach, but I suspect it won’t work in an at-will employment state like California.
