You know without getting too verbose and lost in my own verbiage, it makes me sad to see such avwonderful discussion of Election precedents and Constitutional law from some of you pedes. You all are really brilliant and articulate at putting forward a really thought provoking discussion here, in an attempt to suss out the role of Pence and whether the moves were planned or not and by whom.
But then it strikes me, that we are discussing these election rules and precedents and their utility and if potential moves like proceeding with the count or stopping to investigate or simply returning the electors was legally grey or ethical or it was within the law or would've been technically illegal or this or that. We are talking about this shit, in the context of what actions were taken and why and perfect world scenarios and strict principles and how the framers intended.
But the actual fucking context is, what went down and what pence 'chose' to do (or couldn't choose, bullshit tbh there is always a choice) on Jan. 6th is being rehashed because of an investigation into a supposed "conspiracy" that is so farcical and embarrassing that it actually rivals the Russiagate events and Mueller special task force in terms of how ridiculous and produced it is. The only conspiracy to come from this will be the investigation into the investigation itself, much like what the Durham saga is dredging up from the muck for the public to see from the first tentpole of unhinged lunacy that was nothing more than a bloodthirsty mafia of politicians out to utterly destroy Trump at any cost, committing numerous major crimes in their madness.
It will be the same with this lunatic bullshit and in time we'll find out what we already know: Pelosi and the 3 letters, along with the shadow rulers BHO HRC ETC. orchestrated and perpetrated much or all of the Jan 6 "dustup" to serve dual purposes of finding probable cause to banish Trump eternally at the same moment they completed their hostile takeover after cheating him out of an election he won AND to punish the majority of all people in the country with whom Trump enjoyed massive success and popularity, finding methods to make acceptable and necessary to relegate that disloyal deplorable citizenry to a status little better than indentured servants. They made it up, to stop the election challenges, to show the people we are dogs who will be beaten with the newspaper should we so dare as laugh when they flee in terror from patriotic protestors, to permanently frame Trump as a villain, to do what every major news event of these last few years does: all false flags or certainly narrated and coerced into their estimation of a proper shape; incite anger and draw lines of division. Dethrone compassion and humanity, enshrine our separate living 'truths' and make us worship holy politics.
The context is Pence and the events of Jan 6 put a regime in power that has absolutely no intention of following any Constitutional precedents, rules, or laws of any kind. They operate entirely outside the boundaries of these conditions that we are debating and mulling over. They take what they want and do what they want with fucking impunity and nothing stops them. They are struck down by courts and continue along anyway. Their corruption is exposed and they laugh at it and brush it off. Their agendas and plans are exposed and they redouble the efforts. They are like terrorists in politics, they dont fear "death" in the political sense. Popularity doesnt matter votes dont mean shit, we're going to cheat and lie and tell you who voted and how many and you'll accept it. We own the information and we tell the stories. That's who THESE people are.
As Trump said before Republicans play 'a clean game'. these motherfuckers play to win. Pence could've done whatever he wanted that day. We put ourselves in shackles and remain supplicant to them because whenever we take power we suddenly have to follow a set of rules and law that literally doesn't exist to them, as we see now. If it doesn't change, then we will never have a chance. That's the fundamental difference between MAGA and the old guard. We know they are controlled opposition and part of the show, that's why they suddenly can't get past the same rules that these assholes ignore every time we take power back. That's why I don't think we're going to get to November before something happens, because nothing is bigger than holding on to power and the endless false dialectic. They went crazy in 2016 when the light started to pour in and it's only gonna get worse.

No, there isn't always a choice. And there wasn't in this case. Assuming for a moment that he did have a choice, that would mean the founders of our democracy put in place a mechanism for a single individual (who may well have a stake in the outcome of the election) to decide to invalidate the will of the people who voted. Not likely and not logical. Had Pence done so, then this paragraph could just as equally be applied to the Trump administration:
Fun fact, Jefferson single handedly put himself into office in 1800 by counting the dubious certificate from GA. He of course wasn't going to reject it and all those votes for himself.... had he rejected it, or it been more forcibly objected to, or challenged at the court, there'd have been a contingent election in the House between Adams and Jefferson because neither would have a majority. Thing is, Adams had set the precedent in the prior election by counting the RI certificate even though there were some questions about it (wouldn't have made a difference in the win for Adams, and the questions over the certificate were not at the same level as the GA certificate in 1800).
The Framers never intended the VP to have any supposed unilateral exclusive, supreme power to reject or not accept Electoral certificates. But the problem is that the Constitution did not explicitly spell out a process for what would happen if Electoral appointments or votes were disputed... or perhaps they did... oh yes, they certainly did... Judicial matters are up to the courts, and cases like this belong to SCOTUS which has original jurisdiction. Hence, why even despite the ECA in the aftermath if 1876, SCOTUS has ruled many times in Electoral matters.
