I get what you're saying, it should've been 9-0.

Because 2 + 2 is 4 and to say otherwise would mean you're pushing some kind of activism and ignoring reality.

So in that case I'd agree that 3 of the justices are "illegitimate" but not the other 6.

EDIT: Well, maybe not 5 of them. Roberts IMO is hugely suspicious.
