The US Government's position is that higher ups are "always working" and can never engage in personal activity.

Of course, that's their position, because they are trying to get away with their crimes.

But that does not mean they are right.

No government employee has the authority to cross the line from "doing their job" to using the cover of their job to engage in criminal activity.
