"to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence."
Speech and debate is about them having protections to shield THEM from prosecution while in session or going to and from a session. It does NOT shield them from being witnesses in a case against another person.
They can't be charged with a crime unless its a felony, treason, etc. That doesn't prevent them from being subpoenaed as a witness to an event. In fact quite the opposite... while giving such testimony they have a sort of limited immunity so they have no excuse not to tell the whole truth unless they committed a serious crime(see list). In other words if they plead the 5th it is a CLEAR sign they did something REALLY fucked up and don't want to talk about it. Cough... treason... cough.
Also... I'm no legal scholar but the 6th amendment comes after article one. It clearly takes precedence. Meaning it should override the previous text or at least be given some extra wieght.
Hopefully Bannon wasn’t talking shit when he said this will be the misdemeanor from hell.
Talk about insurrection!
if they are a party to the case he can subpoena them.
The Speech and Debate clause of the Constitution gives them immunity for anything they say in session, and they are banking on it.
Apparently not.
