Why would Hunter Biden have executive privilege available to him. He is not a cabinet member nor does he hold a White House position. Joe Biden canβt invoke executive privilege unless it relates to presidential duties and actions. However, if Joe Biden weβre to pardon Hunter then Hunter could not invoke his fifth amendment right against self incrimination. Thatβs an interesting conundrum for the Bidenβs.
He has deep state privilege. So as a consequence, I highly doubt that anyone is going to pursue him. And no, he doesn't lose his 5th amendment rights upon a pardon. Because a pardon only covers federal crimes. He could still be charged for violating state laws on just about every awful thing we have seen that he has done. Thus, would still have the right to refuse to put himself in jeopardy of being charged under state law.
