The Military IS* fucking losing it
Disclosure: I’m AD and forced inoculated (not a pure blood)
We all know the reason the military vaccine mandate was unlawful (we never had a fully approved vaccine). Regardless, the military pretended they were issuing a lawful order. How do I know they were aware of the unlawful order being issued?
No service member has been punished for refusing this “lawful order.” Failure to obey a lawful order is punishable under the UCMJ. So why were members only separated but not punished?
To punish a service member, they are typically brought to NJP (non judicial punishment). From there they can go through the process and eventually end up face to face with their unit commander if need be. To date, no one has been brought to NJP for refusing the “vaccine.” They have only been separated from service. So why is the military not going after those who refuse what is claimed to be a lawful order? Why allow good order and discipline to wither away?
If the military forced refusers to go through NJP, at any point in the process that member has the right to request trial by court martial. At that point, it becomes very much a judicial process. This trial would then set legal precedent for the rest of the military….. The Military knows it would lose on the merits. This exact process is given example in Band of Brothers when Dick Winters requests court martial when he is brought to NJP on frivolous charges.
Sorry you felt you had no choice. That is a terrible situation. You want to 'be there' for your family by supporting them financially, but risk that you won't 'be there' for them if you have a bad reaction to the shot. Terrible.
Since you brought up this whole issue of refusers and NJP, I'd appreciate it if you'd answer this question from your perspective; why didn't you (and others, though you can't answer for anybody else, I realize) use the full force of the US Constitution to refuse the shots? What I was told when I asked this of someone else was that when people join the military they actually give up some of their constitutionally protected rights. That makes no sense to me. Is that why you felt cornered into taking it? Also, reading through the comments I saw comirnaty brought up. My understanding is that that version was never even produced, it wasn't going to be produced until 2023 and pfizer has since scrapped plans to even do that.
Correct, comnarity wasn’t/isn’t being produced. I have heard recently it may be but I’m uncertain.
The constitutional point is a weird grey area (on purpose). We are protected by the constitution. But the military has the right to make us get vaccines (fully approved). It’s common place to be given a whole array upon entering. It’s also common to be required certain vaccines when deploying to certain areas.
The reason I felt compelled was due to timing. When the military decides something (pentagon) they expect a quick return on order for these things. So we all get threatened with separation. As in, if you do not take this within three month you’ll be forced out thank you for your service. I fought it to the very last day, but the bureaucracy doesn’t allow dissent. My job is to decide what orders are lawful and unlawful. I deemed this one unlawful and did as much as possible to push that message up. At the end of the day, I felt I couldn’t chance hurting my family.
It is very unconstitutional what happened and I continue to fight it from within. We don’t lose our rights, but we do forfeit some privilege. Unfortunately those two things are quite often misinterpreted
