I agree. What is not clear to me is why Bannon didn't appeal on the merits of the matter. Maybe my memory has missed something here.

I'm not sure what the appeal will look like. I'm guessing his attorneys will throw everything at it that was wrong. What I wonder is: Were they preparing for and have they already filed the appeal?
