There are 2 cases. Loy Brunson has 1 case, which is still stuck in a Utah court (the judge is sitting on it and won't do anything).
The other is by his brother, Raland Brunson. This one, the judge ruled to dismiss. He appealed to the Appeals court. They ruled to dismiss. Now, he is appealing to the United States Supreme Court.
The Brunson brothers have a website with info:

NOTE: Read through the history of the 2 cases. These guys are taking it to ALL government employees who refuse to do their jobs! Amazing work.
The SC has accepted this case and will decide on it. They only need 4 to vote yes in order for it to move forward. They do not need the majority vote because national security is at stake.
I don't think that is correct.
They have moved it to conference. That means the justices will meet by themselves (no parties to the case involved), and decide if they will move it to a hearing. They need 4 votes to move it to a hearing.
If moved to a hearing, they will have a hearing (like a trial, of sorts), where the parties can present their cases and answer quesions from the justices. After that, the justices will meet again to decide the case, which will require a 5-vote majority, either way.
