Depending on the crime, being removed from office could be getting off easy. For instance, if a President was accused of treason or murder.
Impeachment hearings are simply not the same as criminal trials.
The impeachment hearings were in the House. The impeachment trial was in the Senate.
I know it is not the same as a criminal trial, but it is also not a civil trial where double jeopardy would not apply. I think it is a grey area that deserves to be researched.
I did a little digging and discovered that there was a clause in the Constitution specifically about this.
Article I, Section 3, Clause 7:
“Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.”
So whatever was decided for the Impeachment applies only to the Impeachment.
Can you explain why it is that Trump is so mistaken? Why would he misinterpret something like that. I mean, if it's in the least bit time consuming or stressful then it would behoove him to only believe things that are true. Otherwise, credibility issues again, and not to mention staying focused on only true things seems like a no-brainer.
No, I can't explain why Trump believes double jeopardy comes into play here.
The man is not Jesus Christ. He's not infallible. He's not a lawyer. And to be blunt, if you look at the people he's hired or had appointed, he's not the best judge of character or intellect. Cohen, Bannon, Sessions, Pence, Bolton, and many others I can't recall at the moment.
On one hand, we have a specific clause in the Constitution that clearly says that double jeopardy doesn't apply to Impeachment decisions.
On the other hand, we have a human being that is not versed in constitutional law, who is a master of the spin, and who is facing being charged with some serious crimes.
Sometimes reality is a bitch and hard to face.
