The Insurrection Act is a law while "martial law" is a concept that doesn't have a legal definition in the U.S. "It's not enshrined anywhere," said Thaddeus Hoffmeister, a law professor at the University of Dayton.
Generally, martial law means that the military takes over civilian control of the government, whereas the Insurrection Act applies to specific instances of rebellion or refusal to uphold the law and requires a state's National Guard or the U.S. military to intervene.

On January 6th, there was a refusal to uphold the law. The law broken would be refusing to look at alternate delegates. This is what the Brunson Supreme Court case is based on.

It does not matter what the committee investigating Jan. 6 finds. The recommended criminal charges going to the DOJ against President Donald Trump are null and void. The marker that pushes the military to step forward may be the attempt to arrest President Trump.
We have been waiting for Durham to issue his findings. If we are under martial law, he most likely handed his findings to a military tribunal. Durham just gathered the evidence; military tribunals will prosecute the guilty. Would it make any sense for Durham to hand his recommended criminal charges to the DOJ? At this stage of the movie, the military has overruled the DOJ's authority.

If martial law has been imposed, it applies to the States as well. The Federal Gov't effectively took over 48 states in 1933 (Article II usurpation of all sovereign states) by switching the state court jurisdiction to Roman Civil Law/Admiralty Law in the form of corporate law call the Uniform Commerical Code (UCC); [This violates Article IV, Section 4 of Constitution (1788)].
This is the same law jurisdiction that applies in Article I courts such as those in Washington, DC, and in all "Federally controlled territories" (controlled by Article I branch, i.e. Congress per Constitution). Article III court jurisdiction (Constitution/Common Law) only applies in Federal District, Circuit, and Supreme Court as long as Supreme Court defends itself form encroachment. So if you are suing over Constitutional Rights issue, you MUST do it in Federal Court only.
Trump had to do something about the infiltration and corruption while he was POTUS. Otherwise it was truly dereliction of duty, and he would not be eligible to serve again, imo.
Yes, I agree. President Trump had a responsibility to do something to protect our nation. He would have failed miserably if he chose to walk away and do nothing. He got in to this battle and planned to fight till the swamp was drained. The swamp draining went through several phases, it took longer than we thought.
The military has authority to take control of civilian courts, at its own discretion. Just because they can it doesn't mean they will in every instance. If they see a judge who is trustworthy and remains bound by the Constitution, they may not intervein at all. They would step in where clear violations of the Constitution are taking place.
