Yeah - I hadn’t checked in on the story and just now heard about that part - won’t work to his favor but hope it doesn’t get ugly for him because of it.
After taking the guy out he took his gun away - and then followed up with another head shot. He is not going to get through this unscathed. Frankly I hope he does go to jail. Assholes like this hand arguments against concealed carry to the gun grabbers on a silver platter. They already think that people that carry are cowboys just looking for a gun fight.
This guy was justified at the beginning, but he was borderline at the point he was shooting the guy trying to leave (spelled out in black and white in the Texas Penal Code) and was definitely over the edge when he executed the guy with a head shot after taking him out and disarming him.
I carry. I would use my gun in a defensive manner without a second thought. I would NOT continue to do what that guy did, and then leave the scene to boot. He incapacitated the robber and disarmed him. All he had to do was keep people back and sit/stand there with his gun pointed at the robber until police got there. He would've been a hero. He also wouldn't be facing a long jail sentence.
tbf, if you aren’t highly trained in battle, your brain doesn’t catch up to what you might do reflexively in the seconds that occur during a highly traumatic event. He might not even realize how many shots he took in those few seconds, or that he did a coup de grace.
