HIPAA laws are very explicit. I wonder if this would stand up in court.
One would think so. But I'll bet if one dug deep enough, there is likely waivers / loop holes when it comes to sharing your info "with the government". That's different than giving to a common criminal. The criminal will just try to steal your money, not your life.
The "loophole" is the customer signing off on their terms of service.
That is likely true. There was a song once warning of "burying us in mounds of paperwork" to keep us blind. The fine print needs to go.
