I have a question? I just lost my job as a PCA, at an Adult Day Healthcare for disabled and Mentally challenged, due to Environmental issues ( Black Mold). My Co worker and I were given 2 days off no pay and told to return Friday, with the building Not being cleaned properly and I refused and was told to wear as mask! NOT! When I said I would Not return they threatened me with job abandonment. I resigned, stating it was not job abdomen but due to the black mold etc... Last night one of the clients called me, and I told them I had left my position and why. Today I got a txt from the owner that I needed to not be in contact with her clients as I signed a confidentiality agreement and if I was she would take legal action towards me! My question, I guess is... is telling someone who called you about black mold a violation of mental health? I did Not contact them! ( this is the only person I've had contact with, )
If you have a confidentiality agreement or a NDA (non-disclosure agreement) it will most likely cover the information you share with people, regardless of whether they contact you or you contact them. That's not relevant. What's relevant is that the agreement restricts you from sharing information.
Read the agreement carefully to see what information you are not allowed (legally) to share.
All you need to do is report the black mold to public health and safety. They will be required to have it remediated professionally. I’m not sure about your job, but at the very least, you could protect others from getting sick. Black mold is serious, and just because people are older or have mental issues doesn’t mean they should have to suffer with the risks involved with black mold.
Thank you. I did report the black mold with pictures to the dept of environmental health and safety of GA! I did try to have them shut the center down.
I’m really sorry about you losing your job, however… If there is black mold there, you don’t want to be working there. You may have a Workmen’s Comp. suite. Since you have filed a report with health and human services, follow up and get a case number. Then call the EEOC. As much as all these organizations suck, there are times when you can use them to benefit yourself.
Good idea thank you! My step sister and I are also going to file against GA nursing board since the owner is a nurse and the owner of the company. Step sister works for GDC.
