TDLR: It is a fake contract, and sheeple being tricked without recourse in Contractual Law.
In order for a contract to be valid where the supplier takes on liability, there has to be an "exchange" where the someone pays for the good offered by the supplier.
So if you slip a roofie in a drink and give it to a woman you're golden as long as it's free?

Good points. You are correct. It is still a crime if you do harm, even if the person "consents", but is unaware. The point is that a crime cannot be legalized with an agreement disguised as a contract that authorizes the crime, effectively.
I believe the bad guy thinking is that they are operating under Trust Law, and what they do is legal even if the victims do not understand what they are consenting to. Pretty sure they f'ed up legally in numerous way.
