In order for a contract to be valid where the supplier takes on liability, there has to be an "exchange" where the someone pays for the good offered by the supplier.
Correct. Just pointing out that they intentionally manipulated the situation to avoid the obvious form of liability if they truly were doing it "for our protection". Not liable per contract law, but clearly liable under other types of law.
Also, if it was highly effective and truly worked, economics of demand would indicate astronomical prices to get it. Valuable product in low supply should not be free, even with go'vt subsidies. Black market should have developed, and not clear that it did.
