March 27, 2023 - All Plaintiffs Must Complete a Plaintiff Fact Sheet to Remain in the MDL
Last week, Judge Cote adopted a uniform Plaintiff Fact Sheet (PFS) that every new and current plaintiff must complete. This 35-page long document requests more information than most mass tort lawsuit fact sheets. As expected, the PFS asks for the names of the products used during pregnancy and when the plaintiff used them.
However, a large portion of the PFS focuses on the genetic and medical history of the parents and affected child. These questions could be an attempt to identify plaintiffs with genetic risk factors that could cause autism or ADHD. We expect the defendants would use genetic information to argue the child's autism diagnosis stems from their medical history rather than acetaminophen use during pregnancy.
