Why won't Fox News use this State Department cable published by WikiLeaks to get their lawsuit dismissed?...

This was the CIA's assessment of SMARTMATIC as far back as 2006. The cable makes all the same accusations that their guests did.
How can they get sued for having the same opinion as this classified briefing sent to our State Department, National Security Council and the U.S. Southern Command?
Why would Fox News settle - are there more skeletons in their closet that they don't want revealed?

The only answer is Discovery
Had Fox fought this they themselves would be subject to the discovery phase of the lawsuit in which all evidence is submitted to the court and either allowed or denied. The process itself sometimes can sink the case before it even gets started.
The problem that Fox has, and don't get me wrong here everyone.... in this case it's Fox but all media outlets are guilty.... The problem Fox has is the evidence that could come out are the communications and relationship between the network and smartmatic as a company. Oh, I cannot say "company" without stating the obvious, that other "company" would also get implicated... So, they settle and pay a pittance to bury this. In the end, smartmatic will just funnel that money back to Fox through subsidiary companies in the form of overpriced advertising.
The precedent has been in place for years, but only now are people paying enough attention to catch it. If I were Smartmatic I would go on the down low for a bit, maybe restructure and even change names. Meanwhile the normies think that Fox paid the price for attacking and "falsely" accusing Smartmatic of fraud, when in fact that exact phrase was never said by either.
Optics in politics is an artform. By settling they put that shit to bed in the public sphere and their ready with the next phase....
If I started a GoFundMe campaign to raise enough money to buy out Roger at Fox how much ya think I would have to raise? Now look at that "settlement" and tell me it's significant. Yep.....
Carry On!!!
