Sec. 1.3. Classification Authority.
(a) The authority to classify information originally may be exercised only by:
(1) the President and, in the performance of executive duties, the Vice President;
(2) agency heads and officials designated by the President in the Federal Register; and
(3) United States Government officials delegated this authority pursuant to paragraph (c) of this section.
(If the President has the authority to classify information, it stands to reason that the President can also declassify information.)
Sec. 1.7. Classification Prohibitions and Limitations.
(a) In no case shall information be classified in order to:
(1) conceal violations of law, inefficiency, or administrative error;
(2) prevent embarrassment to a person, organization, or agency;
(3) restrain competition; or
(4) prevent or delay the release of information that does not require protection in the interest of the national security.
If the information that President Trump had in his possession showed violations of law and didn't pose a risk to our national security, it should have never been classified to begin with. To prove the information in Trump's possession should have never been classified and therefore no crime was broken, perhaps Trump should request the information be released to the American people to prove his innocence. Transparency!

I would assume questions will be asked about the FISA warrants.

I think this is leading to a raid of the University of Delaware for 1850 boxes of information that was stored there after Biden donated it to the University. It was stored there in 2012, after 4 years of Biden being VP for Obama. I imagine dirt on Obama is also mixed in.

This is interesting. You must be talking about public opinion here because as I understand it, Trump was able to declassify at will by virtue of his position so he is technically immune.
If hypothetically he weren't allowed to declassify then he shouldn't have had any classified docs at MAL even if they never should have been classified, technically they would be classified and he would still be breaking the law
So really for the public it isn't about the technical situation, it's about showing that documents aren't a threat to national security, just to Trump's corrupt enemies.

How can someone elses criminal actions make your legal actions, criminal? This makes zero sense. But then again they do this all the time lately.
What I mean is, even if the documents were mis-classified on purpose, then they are still technically classified until that has been fixed. Someone who should not have had them on their premises would be breaking the law. Like Biden did.
It's moot anyway in Trump's case. He can declassify at will so whatever docs he had at MAL he had legally.
I think there are some interesting legal angles in this ridiculous case. Seems like, in the past, there was an assumption that, since the President has ultimate declassification authority, anything he takes from office is defacto declassified.
The Rats seem to be arguing that there is some undefined process requirement by POTUS which is currently not written in law. I think they're backing themselves into a corner, because this path ultimately leads to Barry and Billy, but maybe they're willing to potentially sacrifice those bozos after years of litigation just to get Orange Man in the short term.
Then again, someone told us these people are stupid...
