Could this be to call attention to Obama blanket pardoning everyone on the way out (likely including himself)?

I mean to illustrate that it’s unconstitutional and drive that point home now, so when it comes out later they can’t spin that it’s fine?

I wonder if that's what they're trying to do now; suggest it's already conditional so if it comes out Obama did do it, their idiot voters will say it's fine.
