You are counting on the people to refuse, and the courts to honor precedents. To be sure, the courts have ruled categorically that Congress has the power to draft based on Article I of the Constitution. But they've never ruled explicitly that the executive branch doesn't have some kind of similar capacity in a different context. I can't imagine what legal doctrine the Biden regime would argue to justify it, but that doesn't mean they wouldn't try.
