You are counting on the people to refuse, and the courts to honor precedents. To be sure, the courts have ruled categorically that Congress has the power to draft based on Article I of the Constitution. But they've never ruled explicitly that the executive branch doesn't have some kind of similar capacity in a different context. I can't imagine what legal doctrine the Biden regime would argue to justify it, but that doesn't mean they wouldn't try.
If the white hats are in control, then Biden needs to institute the draft before the next election. That would surely change some minds.
The president can't implement the draft. Congress has to pass the legislation and then the president has to sign it into law.
