Do we know for sure that DJT didn’t organise the Space Force in such a way that it doesn’t fall under the Comitatus act or 10 U.S. Code § 275?

Yes we do.

§1385. Use of Army, Navy, Marine Corps, Air Force, and Space Force as posse comitatus Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army, the Navy, the Marine Corps, the Air Force, or the Space Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.

DJT knew heavy cheating was inbound, most likely by foreign (and domestic) actors, I refuse to believe that he didn’t take that into consideration when he created SF.

President Trump did not create Space Force.

It was created by laws written by Congress and passed with veto -proof support.

While the Trump Administration adopted the push to create the Space Force, it was proposed in 2017 by a Congressman from Alabama.
