I wouldn't bank on that. The ATF classifies the lower receiver as a firearm regardless of any of the rest of the gun being connected. The same would go for a pistol and the slide. Take off the slide and you still have a firearm.

I don't like it but I wouldn't get into a pissing contest with the ATF either. I'll run out of my money defending myself before they run out of my money prosecuting me.
