Also, 16 years old is age of consent in a lot of states so your example doesn't really work there either -- and also falls within most realms of Romeo and Juliet style legislation anyway.
I understand your point and I don't necessarily believe you're totally wrong, but I do believe a lot of it is wrong and you are also not articulating it very well.
Now, I am also in favor of cruel and unusual punishment for these things so you won't find a ton of sympathy from me -- it's better to strike the fear into the hearts of would-be offenders than to offer provisions that would allow them to feel safe making those "mistakes".
