I get where you're coming from, I really do mate. In my worldview it's one of things that rarely requires any hair splitting, but with some situations it can matter. I'm certainly not suggesting evey person accused or charged of a sex crime needs to be screened for intent and competence. That would be silly. It should be possible to have edge cases without a slippery slope. I know it's not always possible.
