Two things:

Watching a thing occur is not the same as doing it. The crimes are not "his fault".
Being commander in chief is very different from being a president in the White House. If they were the same thing, one of the titles isn't necessary.

Article II Section 2

The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States.

According to our Constitution, they are indeed one in the same.
