It's not completely adjudicated. It's a stay on the sentence while the appeal is in motion. If he loses, he will take it to the Supreme Court. Personally, it needs to go to the SC to give all meme makers 1st amendment protection they have the right to according to our founding Constitution/Bill of rights.
