I recently got a misdemeanor.
Nobody was injured. No property was damaged.
It is my firm belief at this point that any such statute is available for review by a jury of my peers, and may be Nullified if that jury seems it to be a silly statute.
The statute may then also be tried to see if it should stand.
The jury acts as a check on the legislature (via judicial review - which is a jury power, not a judge power)
The jury acts as a check on the executive (via militia)

I tried asking a lawyer about how to get around this. The way the law is written, it gives the executive branch exclusive power to decide who comes in the country and who doesn't.
So the executive branch can say, "no more Chinese people" and that's something that the law allows for. To the point of the vaccine mandates I asked, "what if they require someone to take cyanide" and the lawyer replied, "it's pretty much that crazy".
The response I got was that there's no simple way to get this in front of a court. I could try, but the government would probably rule in favor of itself and it would be until an appeals court where I'd be able to put up the constitutional argument of the requirement being unjustified, arbitrary or cruel and unsual.
And that entire time I'd be bleeding money, and still not allowed inside the country and I probably wouldn't get anything for it. From there they effectly hinted that I'd need to wait for Trump or wait for the news around the COVID vaxx so bad the CDC would be forced to back down.
So as th government gaslights people and says "we never forced anyone to get the vaxx", by all means point out that the government is STILL trying to force people to get the vaxx.
Yeah, this is the frustrating part. 99% of people aren't going to give a shit to get visibility on it. And the rule only applies to legal immigrants. So non-immigrants (tourists) and probably illegal immigrants can go to and from the USA spreading as much covid as they want, while green card applicants are still forced to take poison.
I wouldn't care about this either, problem is it's preventing me and my family from even entering the country after 3 years, and 10k spent on the application. So i'm super salty about being singled out on this completely arbitrary requirement.
I don’t claim to know all the problems or how to even kindof fix them, but immigration needs some serious reform.
We can’t have people importing people en masse to achieve political goals.
We can’t have them being imported just to get cheaper labor.
We can’t have them coming in for societal reshaping because the current population is noncompliant.
We can’t have people coming in just because they’re friends, family, or business partners, the wider population needs to somehow be ok with it, too (I’m sure your wife is fine, I have a close friend with this same issue, but there still have to be agreed upon vetting and exclusion criteria)
We need to be able to identify and agree on people that we want to let in, and for what amount of time or purpose (replacing a huge percentage of IT workers with H1Bs, who then somehow buy property and become citizens - based off what? - shouldn’t be allowed)
How do we identify who can be American, especially at this point, where it isn’t clear even among natives?
(Are Jane Fonda and John Kerry “American”? How do we identify traitors who should become excluded from the ranks, and enforce it?)
