It's prosecutorial discretion, just like Comey not charging Hillary, but it appears that only goes in one direction.

That seems to be a violation of the 14th amendments equal protection clause…

Same thing with speeding tickets. If those are written up to protect the public, then any officer deciding not to write you up is not providing equal protection under the law.
