The defendant intended to discriminate against plaintiff on the basis of race; and
The discrimination concerned one or more of the activities enumerated in § 1981, such as making and enforcing contracts, suing and being sued, or giving evidence.

They may be a little weird on how they enforce it, based on the lawyer and regulator and judge involved, sometimes they’ll get the “any race” involved, and sometimes they’ll get “minority” involved. The code as a whole doesn’t seem to be consistent.
Would be interesting to see this code get plugged into a semaphore evaluator and checked for consistency. It’s probably the Windows ME of statutory stability.

So, I guess any of the blacks and hispanics arrested for crimes and labeled as 'white' are ineligible for the job? :)
