The process would ideally be: legislation proposed -> goes to SCROTUS for yes/no on whether it abides by the Constitution or not -> back to congress for yes/no vote, then to president if yes vote. If SCROTUS votes that something is unconstitutional, then it cannot be proposed again. To add strength, an amendment should be proposed and passed to shackle the absolute shit out of congress - term limits, minimum and maximum ages, paid a small stipend, accommodations like the military, no dual citizenship. A prior criminal conviction will bar them from running for life, and if convicted while in office, they are immediately kicked out and barred for life. Any whose name is on proposed legislation that has it kicked back for being unconstitutional has one warning placed on them. If it happens again, they are immediately removed from office and barred from running again.
Hopefully that would help reign it in.
