The trouble is he WAS NOT defending him self. They had walked away, he walks out the front of the store, engages again. They had no weapons in hand. He accidentally pulled the trigger. Extreamly sad and very likely most of us might have acted in a similar manner with adrenalin flowing.
He should have taken more decisive action from the start of the incident while still inside the store. It would have be clearly self defense then.

He is very likely to be convicted based on the final encounter. He should have been more decisive at the start and shot them then. They would still book him, but he would be far more likely to have this dismissed as self defense then.
