I forgot about that. My company was going to do that but I left that company at the end of November and the surcharge would have started in January. I would ask for the money back via a bonus (double bonus to cover the taxes.) You can gently point out it is better than being sued.

Company's in chapter 11 now as of a few weeks ago so that is pretty unlikely to happen.
