Most of what the Jan6 defendants did should be regarded as a misdemeanor considering, they were waved in by Capitol Police and the Capitol Police made no attempt to dissuade entry. How about BLM and Antifa who murdered, set fire to buildings and destroyed property? Garland turned a blind eye.
