Note prosecution for both civil fraud (including RICO) and criminal fraud still appear to be on the table even if we can’t get an 18 USC 2384 charge against each of them. Note statutory penalty for civil fraud is 3x compensatory and 200x punitive for actual damages. This might be a good start.
