I think where Paxton struggled is the word "willful" is not even found in the original complaint:

If willfulness is fundamental to piercing Pfizer's protection, shouldn't it be all over their claim? Maybe an appeal will open up the opportunity for them to demonstrate it.

We need to find a way that PREP can be declared unconstitutional.

I am confused by how Paxton could not have been aware of the details of PREP.
