I stand corrected - I read up on the issue some more and preemptive ARE legal but they are kind of an admission that a federal offense has been committed. Here's a post I made on it, if you're interested:
These pardons only cover what happened in the past- not future crimes… these people can still be called to testify in front of Congress- if they have been pardoned then they are absolutely compelled to tell the truth when questioned under oath…these people cannot tell the truth…
They can be compelled to stand before congress but they still have their 5th Amendment right to refuse to incriminate themselves unless Congress grants them immunity, pardon does not factor into Congressional testimony. They could, however, be tried in State courts for crimes committed in those states or against the citizens of those states. They could also be prosecuted for contempt of congress if they refuse to appear.
