Once the cops entered the movie theater, he began shouting, "I am not resisting arrest!" and they had no choice but to take him alive

He sat in the back waiting. When the police eventually walked right up to him he said "Well, it's all over now!" The police officer tried to plant a gun on Oswald. And that's when Oswald started yelling he wasn't resisting.
