Some states, including California, also have EITCs that can be claimed above and beyond the federal EITCs. In CA, the illegals qualify for the state level EITCs the same as legals and regular citizens.
I do not know if NY has EITCs or if the illegals are allowed to claim them, but its implied by the video.
Edit to add: The state of CA will give a state issued ITIN # to any illegal who wants one, so as far as CA is concerned, they are legal, even if not recognized by the feds. I am guessing NY is the same.

It depends on if NY will give anyone an ITIN # like CA does and what you define as illegal.
If NY gives every migrant who wants one an ITIN #, the state views them as legal. Then Jackson Hewitt would only file a state return for those people, not a federal return.
If NY does not give out ITIN #s like candy, then Jackson Hewitt would only be doing returns for federally recognized legal migrants (asylum seekers, etc).
In CA, the state level EITC is a carrot to entice illegals to register for an ITIN #. Since CA and NY are so similar in policy, my guess is NY probably doing the same.
