Question: Wouldn't these people be at a military tribunal if the charge is sedition and treason? If so they would be at Gitmo. I hear those trials last about 3 days.
Treason is charged by CONgress and prosecuted by the DOJ. There are also state treason charges, and yes - the military can bring treason charges on military members and DOD employees.
If the Federal Court system can be shown to be non-functional it is possible for the President to establish military tribunals and only then could they prosecute Treason against civilians.
By the way - currently only military or enemy combatants can be tried (at GITMO) before Military Tribunals. Any US Citizens that are there are subject to Federal Law (not Military). Again - unless the Federal courts are non-functional.
