I believe that international treaties/law/Court set it so that you cannot take over a country by force anymore.This occurred in the 1940's as OSS was becoming the CIA. And the Department t of War the Department of Defense. The CIA was subverted from its intended role of Data collection and Analysis into the Department of State's "Dirty Tricks" shop.
Thus we have Proxy wars, Subversion and Information wars as the end run around the "cannot take over by force" clause. So we no longer have "Declarations of War". Congress only complains about not being consulted as an act and political posture.
The Democrats Declared war at the outset of the Civil War, but because New York was always the center of their dirty tricks operations they never ended the war.
